This document sets out the terms and conditions applicable to purchases made through the online store available at messervice.eu (the “Store”).

(Hereinafter referred to as “Seller”, “we”, or “us”.)

2. Scope of application

These Terms & Conditions apply to all purchases made in the Store by:

  • Consumers (private individuals), and

  • Business customers (legal entities or individuals acting for professional purposes).

By placing an order, you confirm that you have read and accepted these Terms & Conditions.

3. Nature of products (custom-made goods)

The majority of products sold in this Store are custom-made or assembled according to the buyer’s individual specifications (e.g. configuration, size, fittings, technical parameters).

⚠️ Important:
The buyer is responsible for selecting correct product specifications. We recommend verifying compatibility before placing an order.

4. Ordering and contract formation

  • Placing an order constitutes an offer to purchase.

  • A sales contract is concluded when:

    • we confirm your order by email, or

    • production or dispatch of the goods begins.

  • We reserve the right to refuse or cancel an order if:

    • incorrect or incomplete information is provided,

    • payment is not received,

    • a technical or pricing error occurs.

5. Prices and VAT

  • Prices are displayed in the Store and may be shown with or without VAT, depending on the buyer’s status and delivery country.

  • Shipping costs are calculated and displayed at checkout before order confirmation.

  • No customs duties apply to deliveries within the European Union.

6. Payment

Available payment methods are displayed at checkout.
Orders are processed only after full payment is received, unless otherwise agreed in writing.

7. Delivery (European Union only)

  • We deliver only within the European Union (EU).

  • Estimated delivery times depend on:

    • product type (custom-made),

    • production time,

    • destination country.

  • If no specific delivery term is stated, delivery will be completed within a reasonable time frame, generally not exceeding 30 days, unless production requires longer.

  • Risk of loss passes to the buyer upon receipt of the goods.

8. Inspection upon delivery

The buyer must inspect the goods immediately after delivery.

If any of the following are identified:

  • damaged packaging,

  • damaged goods,

  • incorrect or missing items,

the buyer must contact us without delay and provide order details and photographic evidence.

9. Right of withdrawal – limitation for custom-made goods

9.1 Custom-made products (no withdrawal right)

In accordance with EU consumer protection law, the 14-day right of withdrawal does NOT apply to:

  • goods made to order,

  • goods manufactured according to individual specifications,

  • personalised products.

As most products sold in this Store are custom-made, returns without defects are generally not accepted.

9.2 Standard (non-custom) products

If a product is explicitly identified as non-custom, consumers may withdraw from the purchase within 14 calendar days, provided that:

  • the product has not been used,

  • it is returned in original condition and packaging.

In such cases, return shipping costs are borne by the buyer.

10. Defective or non-conforming goods

If goods are defective or do not conform to the order:

  • the buyer must notify the Seller promptly,

  • return shipping costs are covered by the Seller,

  • the Seller may offer:

    • repair,

    • replacement,

    • price reduction,

    • or refund, depending on the situation.

11. Legal guarantee (EU consumers)

Consumers are entitled to a minimum 2-year legal guarantee for defective goods under EU law.

The guarantee does not apply to defects caused by:

  • incorrect product selection,

  • improper installation or use,

  • unauthorised modifications,

  • normal wear and tear.

12. Business customers (B2B)

Business customers are not entitled to consumer withdrawal rights.
Any returns or order changes require prior written approval from the Seller.

13. Liability

  • The Seller is not liable for indirect or consequential damages, unless required by mandatory law.

  • The buyer is responsible for ensuring product suitability for their intended use.

14. Intellectual property

All content on messervice.eu, including texts, images, and technical materials, is the intellectual property of the Seller and may not be used without permission.

15. Personal data

Personal data is processed in accordance with applicable data protection laws and the Store’s Privacy Policy.

16. Governing law and disputes

These Terms & Conditions are governed by the laws of the Republic of Lithuania and applicable EU legislation.
